Choosing a Solicitor to Help With a Negligence Claim

Since the beginning of the creation of man, people have always been trying to get the maximum of wealth of precious commodities by all the means possible. Thus, when people started to live in groups and tribes, they got more and more opportunities to get their hands on the belongings and precious possessions of others. A system of law was created to protect the rights of the weak and to make sure that the strong do not destroy the weak to get stronger.

Professional negligence is a term used to refer to some sort of negligence rendered by a professional under licence to provide services to the general public. In simple words, professional negligence is a term used to refer to the act of negligence on part of a professional, hired to do some specific task by some other person. For example, a person goes to a doctor to seek relief from some ailment. The doctor is a professional and it is his duty to examine the patient carefully and make accurate diagnosis of the disease with due diligence. If the doctor, due to any reason, examines the patient with negligence and the patient suffers from any loss due to that negligence, the patient is entitled to file a suit against the doctor for a compensation claim.
Compensation claims for professional negligence are not very common and thus, not many people know about them. For the same reason, it is also very hard to find solicitors and professional lawyers for such claims. Not many solicitors are trained to handle such cases because they do not have the required experience and might not have the accurate knowledge about the technicalities and formalities of such cases.


Therefore, when selecting a solicitor for a professional negligence compensation claim, it is very important to find someone with adequate experience so that he can be helpful in dealing with the legal procedures and formalities of the system of law.

Some law firms specialize in these cases and thus, their help should be sought rather than that of ordinary solicitors. These law firms or independent solicitors are approved by law as specialists in dealing with negligence claims. Getting an untrained solicitor would be the equivalent of dealing with all the things yourself without any help from a professional.

Furthermore, different specialists are efficient in their respective fields. For example, some solicitors are very efficient in clinical negligence claims and thus, they would only be useful in such claims. One should make sure that the solicitor one is hiring is right for the type of negligence claim he is being hired for and also that he has significant experience in dealing with such situations.

When choosing a solicitor for a clinical negligence claim, make sure that the solicitor is listed on the AvMA (action against medical accidents) list. AvMA is the list of approved solicitors by the law who are deemed to be specialized in dealing with clinical negligence claims. One should not go for any other solicitor claiming to be on some other approved list other than the AvMA. However, if one does not have any other option, then it would be better to verify the acceptance and reliability of the solicitor's organization by the law.
